Introductory provisions

The subject of these general terms and conditions (hereinafter referred to as "GTC") are the rights and obligations governing the contractual relationship between the operator of the pension and its clients. These GTC apply to online reservations of accommodation services provided by the pension operator, use of the online reservation system of the pension operator, payment and cancellation conditions of online reservations made by clients through the pension website, as well as all other rights and obligations arising from the legal relationship arising from online booking. By ordering the service through an online reservation, the client confirms that he agrees with the GTC and at this moment they are binding for him. The pension operator reserves the right to unilaterally change these GTC, while the change of the GTC is effective from the date of their publication on the pension operator's website.

Definition of terms

For the purposes of these GTC:

Any natural person, at least 18 years of age, qualified for legal acts or a legal person who concludes a contract with the pension for the provision of services or sends a binding order to the pension for clients.

The pension is the Drak pension, which is operated by the company

The service is any services provided by the pension, especially accommodation, catering, wellness and congress services.

Payment on the day of crediting funds to the account of the pension operator, by taking over at the cashier, resp. the moment when the pension gets the opportunity to dispose of the paid funds

Damage is actual damage and lost profit. The actual damage is compensated in cash, unless the parties agree otherwise.

The contracting party is a pension or client

Conclusion of the contract

The contract means an agreement between the pension and the client on the provision of services.

By concluding the contract, the pension undertakes to provide the client with services in the agreed scope and quality and the client undertakes to pay the pension the agreed price and compensate for any damage caused by the client's fault in connection with the use of services.

The contract is created by confirming the order - the client's reservation by the pension, while the confirmation can be made by e-mail, telephone or in writing.

If the services of the pension have been ordered for the client by a third party, the contracting party is a third party against the pension, with the exception of the right to compensation for damage incurred as a result of the client's fault, where in this case the client is directly liable to the pension. Otherwise, the contracting parties are the pension and the client.

Reservation

When booking online, the client has the opportunity to search for current availability accommodation in the pension according to the requirements specified in the booking form.

When booking online, the client fills in all mandatory information such as the beginning and end of the stay, type of room, or additional services and further fills in the identification data about his person so that the contract can be concluded. By confirming the reservation / binding order /, the client undertakes to make the payment for the ordered service. After filling in all the required data from the client and confirming the reservation, the pension will send the client a confirmation of receipt of a binding order with the reservation number. The assigned reservation number serves as an identification data for payment, implementation of any changes or cancellation of the reservation and confirmation upon arrival.

Terms of payment

The client is obliged to pay the agreed price for the services provided, while the above also applies to services provided by the pension to third parties on the basis of the client's explicit request.

The prices listed in the price list of the pension are final and also include value added tax.

Price lists do not include local taxes and fees, nor the fee for the stay of a pet.

The client is obliged to pay the payment for the stay booked by the client when booking online in full when booking online by credit card or credit card or by bank transfer. By confirming the reservation, the client agrees to make payment for the booked stay in full for the benefit of the pension operator and entitles the operator to accept this payment. The total price of the stay is charged to the bank account of the pension operator. After crediting the payment to the account, the pension operator will confirm the completion of the order to the client's e-mail, either by confirming it or sending another notification to the client.

The reservation is considered guaranteed by the pension at the time of payment of the price for the stay in full and delivery of an e-mail about the completion of the order by confirming it.

Unless otherwise agreed, the pension will issue a proof of payment immediately after payment of the price for the stay and deliver it to the client to the e-mail address specified when filling out the order form. After the end of the client's stay, on the day of his departure, resp. within 14 days at the latest, a tax document will be issued - an invoice in which the ordered and used services of the pension will be charged by the client. The invoice must contain all the requisites stipulated by law no. 222/2004 Coll. on value added tax, as amended. If the client has used other services in addition to the services paid for in advance when booking online, he undertakes to pay these no later than on the day of leaving the pension, in cash or non-cash by payment or credit card.

Payment by credit or debit card can be made before and after using the services, based on the data provided by the client necessary for the payment. By providing data for payment by credit or debit card, the client agrees to its use. The pension has the right to additionally charge the credit or debit card for differences that will be found after its departure (for example, consumption, compensation, etc.), with which the client unconditionally agrees.

The pension is obliged to inform the client by e-mail about any additional settlement of differences from the client's credit or payment card and the reasons for such additional settlement.

Accommodation services

The pension is obliged to make the rooms reserved available to the client from 3.00 pm on the agreed day of arrival. If the client and the pension have agreed on this in writing in advance, he is entitled to hand over the room before 3 pm on the agreed day of arrival. The client is entitled to hand over a specific room only if he has agreed in writing with the pension in advance.

The client is obliged to vacate and hand over the room on the agreed day of departure no later than 10.00 am on the agreed day of departure, unless otherwise agreed in advance. In case of late delivery of the room, the pension is entitled to charge the client 50% of the price of accommodation determined according to the valid price list. If the room is not handed over even before 3.00 pm, the pension is entitled to charge the client 100% of the price of accommodation determined according to the valid price list without the client being entitled to use the room and services associated with accommodation.

If the client does not arrive on the agreed day of arrival by 22.00. the pension is entitled to leave the reserved rooms to another client.

Immediately after handing over the keys to the room, the client is obliged to check the condition of the interior equipment of the room and report any deficiencies, damage or reservations at the reception of the pension. In the event that after the end of the client's stay, the pension finds damage to the room, its interior equipment or missing parts, the client is obliged to compensate the pension for the actual damage in full.

The client's stay in the pension is regulated by the accommodation regulations, which are available at the hotel reception. The accommodation rules are binding for the client.

Change or cancellation of reservation, non-arrival

Cancellation fees

Any changes made to the online reservation by the client can be made electronically by sending an e-mail to the address of the operator info@penziondrak.sk, by phone at: +421 918 378 207 or in writing to the postal address: Demänová 478, Liptovský Mikuláš. When requesting a change to an online reservation, the client is obliged to always state the full name and address specified in the online reservation. If the client requests a change to the online reservation, which cannot be met for capacity or other operational reasons, the pension operator is not obliged to comply with the client's request to change the online reservation, and the client is not entitled to damages or any other performance by the pension operator from due to the impossibility of changing the online reservation.

In case of withdrawal of the client and cancellation of ordered services or in case of partial withdrawal of the client and partial cancellation of ordered services, the pension is entitled to compensation in the form of cancellation fee, which is determined as a percentage of the price of services depending on the time since cancellation. planned start of the provision of services.

Unless otherwise agreed between the pension and the client, the following cancellation fees determined from the price of services apply:

-Cancellation between 15 - 30 days before the scheduled date of commencement of services represents the amount of the cancellation fee …… ..50% of the estimated total price

-Cancellation between 7 - 14 days before the scheduled date of commencement of services represents the amount of the cancellation fee …… ..70% of the estimated total price

-Cancellation 6 or less days before the scheduled date of commencement of services represents the amount of the cancellation fee …….100% of the estimated total price

The amount of the cancellation fee also applies if the client does not perform a specific act leading to the cancellation of the ordered services, but does not actually start the stay.

In case of withdrawal of the client from the contract and cancellation of the reservation or in case of partial withdrawal of the client from the contract and partial cancellation of the reservation or non-entry of the client for the booked stay in exceptional cases (illness, death, disaster, etc.) the pension operator is entitled to waive the right to payment of a cancellation fee on the basis of the submission of credible evidence of the serious cause of the client's withdrawal from the contract and cancellation of the reservation or partial withdrawal of the client and partial cancellation of the reservation or non-arrival of the client.

By confirming the order and expressing consent to these GTC, the client agrees and acknowledges that the pension operator is entitled in case of client withdrawal and cancellation or partial withdrawal from the contract and partial cancellation or non-arrival to unilaterally set off the client's claim for return paid price of the stay when making an online reservation of the stay against the pension operator's claim for payment of the cancellation fee in the amount specified in these GTC in the amount in which these claims overlap, the amount exceeding the mutual credit value of the client and the pension operator in favor of the client non-cash bank transfer to the client's bank account, from which the price of the stay was paid when booking the stay online.

If this information is not known to the pension operator, to the account number that the client notifies the pension operator when canceling the stay, within 30 working days from the day following the client's withdrawal from the contract and cancellation or partial cancellation of the reservation and partial cancellation or non-boarding. Bank fees associated with the refund of the price of the clients' stay are borne by the client.

Privacy

By confirming the reservation, the client acknowledges that the personal data provided by filling in the data during the online reservation are processed in accordance with §10 of Act no. 122/2013 on the protection of personal data and on the amendment of certain laws, as amended.

By confirming the reservation, the client gives the operator in accordance with Act no. 122/2013 on the protection of personal data and on the amendment of certain laws as amended, its express consent to the processing of personal data by which the data are provided to clients when booking online (in the range of name, surname, e-mail, telephone number), purposes of direct marketing (offering company services, sending business announcements and informing about marketing events in the form of e-mail messages, including short message service). In particular, the client agrees that the pension operator may record personal data in electronic form himself or through an authorized intermediary, to store and collect personal data in written and electronic form,

organized, used, and used for the purposes set forth in this paragraph.

The client acknowledges that the operator of the pension processes the data provided by filling in the data when booking online and stores it for the period for which it is necessary to achieve the purpose of the contract. Consent under the previous paragraph shall be granted for an indefinite period. The granting of consent is voluntary and the client may revoke the consent free of charge at the registered office of the pension operator at any time, by a signed written notice addressed to the pension operator. The pension operator acknowledges that the person who provided the data is responsible for the accuracy and completeness of the data provided.

Final provisions

These GTC and the legal relations established on the basis of them are governed by the law of the Slovak Republic.

Should any provision of these GTC be or become invalid, ineffective or unenforceable, such invalidity or ineffectiveness shall not affect the validity and effectiveness of other provisions of these GTC.

These GTC come into force and effect on 1.1. 2020.
